Labor unions support their members' right to choose union leaders to represent them at union meetings, and some unions are challenging such a measure. Many of those challenging the law — including the Service Employees International Union and the United Steelworkers Local 1999 — say they plan to maintain their membership because it ensures a fair share of union labor in the workplace.

"I support the right to organize," Sgro said. "We should do that and keep the government and business out of it, and I think the president supports this right."

In 2010, the U.S. House of Representatives passed a bill creating a right to union representation in federal agencies. The legislation passed easily, but opponents say it is unconstitutional because the government can't require all workers to work together to bargain and win collective bargaining rights.

The president has indicated he is likely to sign the right to union legislation, though the legislation must be reworked, and if passed, could remain secret until it's voted on in committee.
